 Happy New Year!
New Year, New Newsletter

Welcome to our revamped Newsletter bringing you all the news from noblehr and HR in general. Noblehr is not the only one undergoing a sea change it seems!

 

 I am sure you will agree it has been a busy few months for all HR practitioners with the introduction of the New Agency Temporary Worker Directive, removal of age limits for retirees, the change to unfair dismissal rules, not to mention further threats of public sector strikes, proposal to change gold plated public sector pensions, the banking crisis, looming financial clouds(did we ever come out of the last one!), and the great European debacle.

Phew! reminds me of a swirling hurricane, exhausts me even thinking about it. Now I'm wondering how we'll all manage to implement it all and what challenges it will bring.

Changes to unfair dismissal rules

From April 2012 employees with less than 2 years service cannot lodge an unfair dismissal claim. Currently those with more than a years service can make a claim.

 

Its also rumoured that there are plans to make claimants pay an initial fee of £250 to actually lodge a claim and a further fee of £1,000 if the claim is to be heard. Both fees will be refunded if the claimant wins....

I take no pride in the fact that I am no stranger to Employment Tribunals and even less in admitting that most of the claims I have been involved with should never have reached Tribunal at all. It seems anyone with any grudge can and will bring a claim and in most cases lose them (not that the press would have you believe that) without any fear of consequence. The lack of sensible filtration is sorely missing once an ET1 lands on the mat of the Tribunal.

 

Now from April 2012 only those with 2 years service or more will be entitled to lodge an unfair dismissal claim and that is no bad thing.

 

I was heartened by this news, its a start and a very good one.

 

What silly and ridiculous claims have you come across?

 

 

Whats happening in February

 

Quite significant changes as it happens....

From 1st February there will be increased limits on employment tribunal awards
- a weeks pay (for calculating redundancy etc) will rise from £400 to £430
- the maximum award for unfair dismissal claims will rise from £68,400 to £72,300
-guarantee pay will increase from £22.20 to 23.50 per day!Busy times are ahead (when are they not!)
